On June 17, 2022, Wayne E. Cousin, Esq. obtained a unanimous defense verdict on behalf of a general dentist following a 3 week jury trial in Supreme Court, New York County.

The plaintiff alleged Wayne’s client departed from accepted standards of  dental practice in failing to properly treat the patient’s tooth, requiring the need for a root canal and ultimately the tooth’s extraction.  Plaintiff’s theory was that Wayne’s client should have fabricated a bridge, rather than offer an implant that was doomed to fail in light of an unhealthy anchor tooth.  The plaintiff alleged further that Wayne’s client was responsible for the subsequent treating oral surgeon extracting the wrong tooth, as a result of inadequate communication with the oral surgeon.

The jury disagreed and rendered a defense verdict on all claims of dental malpractice.
