On January 4, 2024, Steven Mutz, Esq. secured the dismissal of a lawsuit on summary judgment in Supreme Court, Suffolk County, before the Honorable Justice James F. Quinn.

The plaintiff, on behalf of the deceased resident, commenced suit seeking damages for negligence, medical malpractice and statutory violations pursuant to NYS Public Health Law 2801-d.  More specifically, the lawsuit alleged the skilled nursing facility caused multiple injuries including pressure wounds, osteomyelitis, UTIs, and the inability to ambulate.

The defense established with the assistance of an expert in the field of geriatrics that the staff acted timely and appropriately in evaluating the resident, care planning to reduce the risk of injury, and ensuring all interventions were executed.  The defense further demonstrated that plaintiff’s alleged pressure injuries were caused by vascular insufficiency and not neglectful care.
