Scott R. Singer, Esq. Wins Dismissal on Summary Judgement for Dialysis Center
On November 18, 2022, Scott S. Singer, Esq. obtained dismissal on summary judgment of a medical malpractice case on behalf of a dialysis center in Supreme Court, Kings County.
The plaintiff alleged that an elderly patient was left unattended and fell causing the patient to die from a brain hemorrhage approximately 1 month later. Scott argued before the Court that there was no issue of fact for a jury to decide on the issue of causation. More specifically, Scott presented a neuro-radiologist who opined that the initial CT of the patient’s head shortly after the fall was negative for bleeding on the brain, and that a subsequent CT obtained 28 days later and positive for hemorrhage was not caused by the subject fall.
The Court agreed and granted Scott’s motion for summary judgment. Well done Scott!
