Sheeley LLP obtained dismissal of a case brought by an elderly female patient who received treatment from the defendant, a NYC area home care services provider.  The plaintiff alleged that she suffered from a stage IV sacral pressure ulcer, infection, sepsis, malnutrition, dehydration, osteomyelitis, and wrongful death as a result of the defendant’s negligence.

Sheeley LLP obtained summary judgment by establishing that the defendant’s home care services met the standard of care, and none of the care provided was the proximate cause of the decedent’s injuries.  The plaintiff failed to raise an issue of fact on these issues.
