Andrew T. Sheeley, Esq. obtains defense verdict on behalf of a premier children’s hospital

On October 25, 2021, Andrew T. Sheeley, Esq., obtained a unanimous defense verdict on behalf of a premier children’s hospital following a 6 week jury trial in Supreme Court, Queens County.

Plaintiff, a then 16-year-old healthy high school student, suffered an anoxic brain injury following a prolonged episode of cardiac arrest.  As a result, the plaintiff was left a quadriplegic and dependent on others for all activities of daily living.  He was transferred to the defendant children’s hospital for management of his underlying complex medical condition and subacute rehabilitation.  Plaintiff claimed the hospital was negligent when transferring plaintiff, causing a patella subluxation, requiring reconstruction of the knee and quadriceps muscles, permanent disfigurement and the loss of any opportunity to walk in the future.

Through several physicians treating plaintiff during his hospital admission, along with multiple expert witnesses, Andrew successfully convinced the jury that the hospital did not commit malpractice in transferring plaintiff, and that any injuries were the result of his neuromuscular condition from the devastating brain injury.
