In a Richmond County venued action, the plaintiff was the employee of a medical services company who allegedly slipped and fell on a slippery substance inside the lobby of the building as she was walking to work. A security guard was on hand to witness the incident. She sued the out-of-possession owner, who leased the facility to her employer.
Sheeley LLP obtained summary judgment for the defendant by establishing that it did not owe the plaintiff a duty of care. It also proved that the owner delegated the obligation to maintain the facility to the tenant and did not disturb the operator’s control of the facility. The plaintiff failed to allege an injury caused by a structural or design defect that imposed tort liability on the owner.
The dismissal protected the owner from a substantial personal injury claim.
