On June 23, 2026 , Andrew Sheeley and Collin Spears secured a defense verdict on behalf of a skilled nursing and rehabilitation facility following a 2 1/2 week jury trial in Supreme Court, Nassau County, New York, before The Hon. Phil Solonges.
Plaintiff alleged defendant failed to prevent the development and worsening of pressure injuries in violation of N.Y.S. Public Health Law 2801-d. Following extensive expert testimony, the jury accepted the defense position that as a direct consequence of significant underlying comorbidities the pressure injuries were unavoidable and, despite quality care and treatment, incapable of completely healing. The jury rejected plaintiff’s argument that the patient was neglected.
