Neil B. Ptashnik, Esq. Obtains Defense Verdict On Behalf of Surgeon
On October 28, 2022, Neil B. Ptashnik, Esq., obtained a unanimous defense verdict on behalf of a general surgeon following a 3 week jury trial in Supreme Court, Richmond County.
The plaintiff alleged that Neil’s client departed from accepted standards of care for surgeons in failing to appreciate signs and symptoms of infection of the surgical site of a prior hernia repair with mesh. Plaintiff claimed the failure to diagnose the infection led to further surgical repair with removal of mesh, along with associated pain and suffering over a two year span.
Neil argued successfully that his client acted appropriately at all times during the pre-operative assessments, conducted the surgery without complication and further appreciated all potential signs and symptoms of infection and treated the patient in accordance with the applicable standard of care. The jury agreed and rendered a unanimous verdict for the defense.
