Congratulations to Adam Fischkelta and Elizabeth Dreisbach for obtaining dismissal on summary judgment for a skilled nursing facility in Richmond County, NY.  The plaintiff alleged our client’s staff failed to prescribe postsurgical anticoagulant medication causing her to develop a DVT, which led to a pulmonary embolism.  Although the Court found questions of fact as to the co-defendant medical doctors’ care, Sheeley LLP secured the win by establishing that the nursing home staff met the applicable standard of care and could not be held liable for the medical decisions of nonemployed physicians.
